A multitude of legislation impacts the use of samples and data for research in South Africa. With the coming into effect of the Protection of Personal Information Act No. 4 of 2013 in July 2021, recent attention has been given to safeguarding research participants’ personal information. The protection of participants’ privacy in research is essential, but it is not the only risk at stake in the use and sharing of personal information. Other rights and interests that must also be considered (...) and safeguarded include the right to non-discrimination, the right to dignity, and the right to enjoy the benefits of scientific progress. This can be achieved by ensuring that the ethical values and universal principles that underpin the research landscape, namely equity, reciprocity, justice and solidarity, are embedded in the regulatory framework for the management and use of personal information. This paper advocates an integrated bioethics approach to the use of personal information for research in SA. A key feature in embedding such an approach is a Data Transfer Agreement that appropriately integrates the safeguards and protections set out by our regulatory framework with bioethical rules and procedures when personal information is used and shared for research purposes. This paper thus calls for the development of a national DTA that is guided by key ethical principles when data are shared for research purposes. This paper will be followed by a webinar on 23 June 2022 hosted by the Department of Science and Innovation and the SA Medical Research Council, where the recommendations and suggestions set out herein will be unpacked, discussed and debated by relevant stakeholders. This article presents a set of moral arguments regarding the selective abortion of fetuses on the basis of prenatal screening for late onset genetic diseases only, and for Huntington's Disease* in particular. After discussion of human suffering, human perfection and the distinctive features of the lives of people confronting late onset genetic disease, the author concludes that selective abortion is difficult to justify ethically, although it must remain a matter of personal choice.

In spite of the labours of Sedlmayer,1 Ehwald2 and Palmer,3 it cannot be said that there exists a completely satisfactory edition of Ovid's Heroides. One or all of these editors sometimes leave a corrupted text, sometimes adhere too closely to a manuscript reading, and sometimes introduce untenable emendations. A new edition is called for, with revised collati ons of the known manuscripts, and an augmented apparatus criticus, exhibiting the large class of what I may term the ‘Vulgate’ manuscripts, which represents (...) a tradition different from, and probably later than that of our chief authority, the excellent but unfortunately incomplete eleventh-century Parisinus , which, like all primary manuscripts of this type, contains many readings or corruptions which should not on account of its mere authority be accepted slavishly. Light is often thrown on the text from less important sources, and the truth may be recovered from manuscripts of the ‘Vulgate’ family, where our better authority fails. In this connexion the study of my own manuscript has led me to some conclusions in certain passages which I venture to set forth as suggestions towards an improved constitution of the text of the Heroides. Though it is clear from the preceding investigation into its nature that O is no primary manuscript, but belongs rather to that large class which has passed through various stages of reproduction involving alterations due either to carelessness of copyists or, more rarely, to deliberate alteration, it presents at the same time a phenomenon not unusual with such manuscripts, inasmuch as it often supports the best tradition, and in some cases preserves a reading which yields the truth, or from which the truth can be elucidated. Advances in life-saving technologies in the past few decades have challenged our traditional understandings of death. Traditionally, death was understood to occur when a person stops breathing, their heart stops beating and they are cold to the touch. Today, physicians determine death by relying on a diagnosis of ‘total brain failure’ or by waiting a short while after circulation stops. Evidence has emerged, however, that the conceptual bases for these approaches to determining death are fundamentally flawed and depart substantially from (...) the established biological conception of death. We argue that the current approach to determining death consists of two different types of unacknowledged legal fictions. These legal fictions were developed for practices that are largely ethically legitimate but need to be reconciled with the law. The considerable debate over the determination of death in the medical and scientific literature has not informed the public that vital organs are being procured from still-living donors and it seems unlikely that this information can remain hidden for long. Given the instability of the status quo and the difficulty of making the substantial legal changes required by complete transparency, we argue for a second-best policy solution: acknowledging the legal fictions involved in determining death to move in the direction of greater transparency. This may someday result in more substantial legal change to directly confront the challenges raised by life-sustaining and life-preserving technologies without the need for fictions. (shrink)

This paper contributes to the generalization of lattice-valued models of set theory to non-classical contexts. First, we show that there are infinitely many complete bounded distributive lattices, which are neither Boolean nor Heyting algebra, but are able to validate the negation-free fragment of \. Then, we build lattice-valued models of full \, whose internal logic is weaker than intuitionistic logic. We conclude by using these models to give an independence proof of the Foundation axiom from \.

Since the publication of my critical edition in 1889 the Tristia of Ovid has received some attention. A paper in Hermathena, vol. vii. by Professor R. Ellis contains several conjectural emendations, and in a public lecture on The Second Book of Ovid's ‘Tristia’ , this veteran scholar analysed the intricate contents of Book II. Two learned pamphlets by Dr. R. Ehwald, Ad historiam carminum Ouidianorum recensionemque symbolae deal with the history of the text, and the textual criticism and interpretation generally. (...) We present a case study for the debate between the American and the Australian plans, analyzing a crucial aspect of negation: expressivity within a theory. We discuss the case of non-classical set theories, presenting three different negations and testing their expressivity within algebra-valued structures for ZF-like set theories. We end by proposing a minimal definitional account of negation, inspired by the algebraic framework discussed.

This study is part of a comprehensive investigation of ethical thinking among male and female physicians and nurses. Nine women physicians with different levels of expertise, working in various wards in paediatric clinics at two of the university hospitals in Norway, narrated 37 stories about their experience of being in ethically difficult care situations. All of the interviewees’ narrations were concerned with problems relating to both action ethics and relation ethics. The main focus was on problems in a relation ethics (...) perspective. The most common themes in an action ethics perspective were overtreatment and withholding treatment. The more experienced physicians reasoned differently from the group of less experienced physicians and they coped with pressure in different ways. The less experienced physicians disclosed their professional experience yet seemed uncertain, while putting on an air of certainty, but the more experienced physicians disclosed both their professional and personal experience of caregiving and they seemed to allow themselves to feel uncertain in their certainty. Both groups emphasized a need for deep discussion between colleagues about their being in ethically difficult care situations. (shrink)

Global properties of canonical derivability predicates in Peano Arithmetic) are studied here by means of a suitable propositional modal logic GL. A whole book [1] has appeared on GL and we refer to it for more information and a bibliography on GL. Here we propose a sequent calculus for GL and, by exhibiting a good proof procedure, prove that such calculus admits the elimination of cuts. Most of standard results on GL are then easy consequences: completeness, decidability, finite model property, (...) interpolation and the fixed point theorem. (shrink)

The removal of life-sustaining treatment often brings physicians into conflict with patients. Because of their moral beliefs physicians often respond slowly to the request of patients or their families. People in bioethics have been quick to recommend that in cases of conflict the physician should simply sign off the case and “step aside”. This is not easily done psychologically or morally. Such a resolution also masks a number of more subtle, quite trouble some problems that conflict with the commitment to (...) toleration and moral diversity that it is intended to support. Decompressive craniectomy is a technically straightforward procedure whereby a large section of the cranium is temporarily removed in cases where the intracranial pressure is dangerously high. While its use has been described for a number of conditions, it is increasingly used in the context of severe head injury. As the use of the procedure increases, a significant number of patients may survive a severe head injury who otherwise would have died. Unfortunately some of these patients will be left severely disabled; (...) a condition likened to the RUB, an acronym for the Risk of Unacceptable Badness. Until recently it has been difficult to predict this outcome, however an accurate prediction model has been developed and this has been applied to a large cohort of patients in Western Australia. It is possible to compare the predicted outcome with the observed outcome at 18 months within this cohort. By using predicted and observed outcome data this paper considers the ethical implications in three cases of differing severity of head injury in view of the fact that it is possible to calculate the RUB for each case. Couvalis In his early paper, "On the Improvement of the Sciences and the Arts," Feyerabend argues that, just as rival hypotheses show the shortcomings of entrenched scientific hypotheses, so theatre which presents hypotheses contrary to common beliefs about human beings shows the shortcomings of these beliefs. It develops understanding of human relations more effectively than intellectual debate because (...) it is a more complex medium whose elements can "represent the contrary hypotheses at the same time."1 He takes Brecht to be the first theorist of such a theatre. I shall argue that Brecht's epistemology is similar to Feyerabend's early epistemology and that his dramatic theory is a consequence of it.2 1 shall also argue, however, that Feyerabend is wrong in saying that Brechtian theatre presents contrary hypotheses at the same time, because plays, like descriptions, are theory-laden and Brecht, in any case, intends to show on stage that tragedies have social origins and not to present contrary hypotheses about human beings. According to Brecht, most people improperly assume that human behavior and social relations follow fixed patterns inherent in nature because they have been unable to compare the human behavior they know with that in other societies. They take what they experience to be typically human. Moreover, they interpret their social world as they have been taught: "A child, living in a world of old men... knows the run of things before he can walk."3 Feyerabend brings out the effect of such training very vividly: "The teaching procedures both shape the 'appearance,' or 'phenomenon' and establish a firm connection with words, so that finally the phenomena seem to speak for themselves...."4 Because these interpretations of the social world which children are taught are descriptive, explanatory, and prescriptive, they are more 117 118Philosophy and Literature complex and more dangerous than the interpretations of physical objects they are taught. For example, children learn different evaluations of precisely the same behavior in males and females through being taught how to describe it. In being taught to describe certain behavior as "manly" they are taught both that it arises from a male's nature and that it is laudable behavior for boys but not for girls. "Manly" behavior in a woman is not "confident" or "forthright," but "aggressive" or "pushy." In order to stop us from regarding traditional behavior patterns and social relations as unchangeable, and to enable us to question our descriptions of them, Brecht argues that the dramatist must cause us to cease to regard such patterns and social relations as familiar givens that can only be described in one way. To achieve this, he must not structure his plays on the Aristotelian model. The Aristotelian model makes audiences incapable of criticizing the dramatic message, imparts the view that the sources of tragedy lie in an inexplicable human essence, and presents social rules as if they were unquestionable natural laws. Instead, he should structure his plays to induce in audiences a scientific attitude to social relations and patterns of behavior. Like Feyerabend, Brecht realizes that a scientific attitude is not displayed by collecting descriptions of experience without considering whether the interpretations contained in the descriptions are correct. In Galileo, his view of those who mechanically describe experience in traditional terms is shown in Galileo's replies to the Aristotelian arguments of Andrea. When Andrea argues, "I can see that the sun's not in the same place in the evening and morning. So it can't stand still. It just can't," Galileo replies, "You 'W! What do you see? You see nothing at all. You're just gaping. Gaping isn't seeing." He then demonstrates to Andrea that the apparent motions of objects need not be their real motions because an apparent motion can be caused in more than one way. 5 Brecht shows that the central question for the scientist is not "How shall I collect descriptions of appearances?" but "What is it that I really perceive and how is it caused?" Intuitionistic logic is presented here as part of familiar classical logic which allows mechanical extraction of programs from proofs. to make the material more accessible, basic techniques are presented first for propositional logic; Part II contains extensions to predicate logic. This material provides an introduction and a safe background for reading research literature in logic and computer science as well as advanced monographs. Readers are assumed to be familiar with basic notions of first order logic. One device for making this (...) book short was inventing new proofs of several theorems. The presentation is based on natural deduction. The topics include programming interpretation of intuitionistic logic by simply typed lambda-calculus (Curry-Howard isomorphism), negative translation of classical into intuitionistic logic, normalization of natural deductions, applications to category theory, Kripke models, algebraic and topological semantics, proof-search methods, interpolation theorem. Feferman [5], [7] and Tait [11], [12] reobtained this result forn= 0, 1 and even with instead of. Feferman and Sieg established in [9] the conservativeness of over <ε0for-sentences for alln. In each paper, different methods of proof have been used. In particular, Feferman and Sieg showed how to apply familiar proof-theoretical techniques by passing through languages with Skolem (...) functionals.In this paper we study the same choice principles in the presence of theBar Rule, which permits one to infer the scheme of transfinite induction on a primitive recursive relation ≺ when it has been proved that ≺ is wellfounded. The main result characterizes + as a conservative extension of a system of the autonomously iterated-comprehension axiom for-sentences. Forn= 0 this has been proved by Feferman in the form that + is a conservative extension of <Γ0; this was first done in [8] by use of the Gödel functional interpretation for the stronger systemZω+μ+ + and then more recently by the simpler methods of [9]. The present and future rapid increase in the hospital population of geriatric patients is discussed with particular reference to the problem of advanced brain degeneration. The consequences of various clinical management options are outlined and it is suggested that extreme attempts either to preserve or terminate life are medically, morally and socially unacceptable. The preservation of life in senile patients has important economic consequences. In achieving a decision on the medical management of patients with advanced brain decay it is suggested (...) that substantial help would be derived from: knowledge of the previously declared wishes of individual patients; improvements in geriatric assessments; broader consultation with relatives, and greater use of inter-disciplinary discussion in the preparation of criteria for terminating medical efforts to maintain survival. We show that local realism applied to states characterized by a single quantum equally and coherently shared between a number of qubits (so-called W states) produces predictions incompatible with quantum theory. The origin of this incompatibility is shown to originate from the destructive interference of amplitude probabilities associated with nonlocal states, a phenomenon that has no classical analog.
